Overstrand Municipality is continuing with the steps required to secure a long-term lease for the Yacht Club in Fisherhaven on Erf 775.
Following a competitive bidding process in 2022, a 25-year lease agreement was concluded between the Municipality and Point Caravan Resorts (Pty) Ltd. The agreement subsequently lapsed due to the non-fulfilment of certain suspensive conditions contained in the lease agreement.
The decision to make the property available through a competitive tender process followed the expiry of the previous lease and was guided by the applicable legislative framework, including the Municipal Asset Transfer Regulations and the Municipality’s Supply Chain Management Policy.
Following the lapsing of the lease with Point Caravan Resorts (Pty) Ltd on 1 April 2026, Council approved a short-term lease for a period of 15 months. The purpose of this agreement was to provide the Municipality with time to undertake the required statutory and procurement processes for a new competitive bidding process.
During April 2026, the Municipality advertised its intention to make the premises available through a competitive process and invited comments from the community. Following the public participation process, the tender specifications are currently being finalised ahead of the tender being advertised.
The main purpose of the tender is to ensure continued public access to, and use and enjoyment of, the premises and its facilities. To achieve this, certain formalities, including the subdivision and rezoning of the relevant portion of the property, will need to be completed. These steps are intended to protect the rights and interests of all parties when the tender is awarded to the successful bidder.
The premises can currently be used within the existing developed footprint. However, the successful bidder will be required to appoint a professional team to prepare and submit a Site Development Plan (SDP) for approval by the delegated authority.
The SDP will need to address matters such as land use and, where required, environmental and heritage approvals. The SDP and land use planning process will be subject to public participation, allowing the public an opportunity to comment on the proposal before it is considered by the delegated authority.
