Legislation (The Business Act no 71 of 1991) requires that certain types of businesses need to have a valid business / trade licence before the business starts to operate.

Depending on the type of business, you may need to comply with the following requirements:
- Zoning
- Health
- Safefy (particulartly fire)
- Police Clearance
If you do not have a valid Business Licence, you are in contravention of the Business Act no 71 of 1991 and will be liable for a fine, or imprisonment, or both.

Formal Businesses
In terms of the Businesses Act, 1991 (Act 71 of 1991), a business licence is required for:
- Food businesses that prepare, sell or supply food and beverages for human consumption.
- Health and entertainment businesses, including massage, nail and hair salons, saunas, gaming venues, billiard halls, nightclubs, cinemas, theatres and certain adult entertainment premises.
Depending on the type of business, you may need to comply with the following requirements:
- Zoning
- Building
- Health
- Safety (particularly fire)
- Police clearance
Informal Businesses
An informal trading or hawker permit is required if you:
- Trade from a cart, trolley, table, stall or vehicle.
- Operate from a public place or designated informal trading area.
- Move between different selling locations.
Locations from where such trade may take place are subject to the provisions of the By-law Relating to Streets, Public Places and the Prevention of Public Nuisances of the Overstrand Municipality. Food traders must also obtain a certificate of acceptability (COA) from the Overberg
Spaza shops may be subject to additional zoning and land use requirements. Applicants are advised to contact the Town Planning Department before commencing operations.

If you are not the owner of the shop/building: letter of permission from the owner or a lease agreement
Layout plan and or approved building plans of the internal area of the shop/building
Zoning certificate

Occupancy certificate
Why do you need this? | To confirm approved Building plans are on record and building complies with approved building plans
Where can you get it? | At the Municipal Building Control Offices
Fire Safety Compliance certificate
Why do you need this? | Proof that your premises meet safety standards/regulations
Where can you get it? | At the Municipal Fire Brigade Offices
If you sell food – Certificate of Acceptability (COA)
Why do you need this? | Compliance certificate to food process facilities and vendors

IMPORTANT NOTES
- Allow at least 30 working days for the approval or non-approval of a Business Licence application.
- Only complete applications with all required supporting documents will be accepted and evaluated.
- Businesses may not operate without a valid Business Licence where one is required in terms of the Businesses Act, 71 of 1991.
- Food businesses, entertainment venues, certain health establishments, hawkers and other businesses listed in Schedule 1 of the Businesses Act, 71 of 1991, require a Business Licence before commencing operations.
